Diia.pl confirms the legality of the residence of Ukrainians in Poland and allows them to travel within the Schengen area

On the problem regarding the crossing of the Polish-Ukrainian border and within the Schengen area, we write in the text: War refugees from Ukraine have problems returning to Poland. Aid organizations are concerned that war refugees from Ukraine who have returned to their home countries, for example to arrange administrative matters, are having difficulties returning to Poland. They do not have documents confirming their right to remain in our country or to offer them protection under the Special Assistance Act. In many cases, border guards claim that these individuals stayed in Poland on a visa-free regime and either had to wait 90 days in Ukraine or obtain a visa at the only consulate in Lviv.


Diia.pl – a residence permit

The Ministry of Digitization says that the problem has now been solved. From July 23, citizens of Ukraine will have the opportunity to certify the legality of their residence in Poland using a smartphone, in a fully digital way using the Diia.pl application that is part of mObywatel.

– More than a million Ukrainian citizens already have a Polish PESEL number and almost half a million trusted profile – the key to Polish e-administration. Thanks to them, Ukrainians can use Diia.pl. Lately we have seen a great increase in interest in the application. The document has already been downloaded more than 80 thousand. times and this number is growing rapidly – emphasizes Minister Janusz Cieszyński, State Secretary in the Chancellery of the Prime Minister for Digitization.

From Diia.pl to the Schengen area

In order to regulate the issue of the movement of Ukrainian citizens within the Schengen area and crossing the external border of the EU, the Ministry of the Interior and Administration submitted a declaration of temporary use to the European Commission on 12 July 2022 Diia.pl document as proof of legality of residence in Poland. The information on the document was sent simultaneously to the EU Member States and associated countries of the Schengen area.

After the official notification, the electronic document Diia.pl becomes in the possession of a citizen of Ukraine or another foreigner (whose residence in the territory of the Republic of Poland is considered legal under the law on assistance to Ukrainian citizens in connection with a armed conflict in that country), acts as a residence permit that is used together with a valid travel document to cross the external border of the EU. It also allows movement within the Schengen area for 90 days in any 180-day period.

How Diia.pl . to use

People with Ukrainian citizenship can use the Diia.pl digital ID after obtaining a PESEL number and activating a trusted profile. When applying for a Polish PESEL number, a trusted profile can be accessed at the office. If you didn’t do it right away, you can go to the same point where you obtained the PESEL and request a trusted profile. Such an application can also be made at the confirmation point or any municipal office – however, a passport is required as supporting document.

Ukrainian citizens with a PESEL number and a valid passport they can also submit online application for a trusted profileand then confirm it in the confirmation section or they can confirm the trusted profile themselves, if have an account with one of the selected banks.

Who can use the mObywatel application and the Diia.pl document?

Any person who:

  • has Ukrainian nationality,
  • is of legal age,
  • crossed the Polish-Ukrainian border after February 24, 2022,
  • has a PESEL number,
  • has an active trusted profile.

The mObywat application is free. The publisher is the Chancellery of the Prime Minister. It can be downloaded from the official App Store and Google Play stores. The application works on smartphones with the following system: android 6.0 (up) and iOS 13.0 (and above).
