Increasing the minimum allowance for foster families and making changes to the amount of leave for adoptive parents – such as: solutions are being considered in the draft amendment to the law on the support of the family and foster care system, which will be considered by the Sejm on Thursday.

The schedule on the Sejm’s website shows that the debate on the draft changes to the foster care system is scheduled for 10:45 p.m.

The regulation drawn up by the family ministry contains solutions to improve the system of family support, foster care and adoption. These include supporting the development of foster care family forms and improving the situation of adult foster care rates.

The project aims to introduce a fundamental ban on the creation of new care and training centers of the socialization, intervention and specialist therapeutic type, as well as regional care and therapy centers and pre-adoption intervention centers. The possibility of transforming these institutions was left so as not to increase the number of places in institutional forms in a particular poviat and voivodship respectively.

The amendment also aims to improve the organization of adoption procedures and the rights of motherhood for adopters of older children.

The compensation of professional foster families and families running family orphanages will be increased from PLN 2,168.76 to PLN 3,100. This fee is indexed.

The draft also provides for changes to the extent of paternity leave, maternity leave and parental leave for an employee who has adopted a child for the upbringing with the consent of the court. These rights generally apply until the child has reached the age of 7 years. The proposed changes extend these rights until the child turns 14.

In addition, the project provides the opportunity to return to the current foster home, family orphanage, care and educational institution or a regional care and therapy center for a person who has already left these forms of care and has started the process of independence, but would love to return for a variety of reasons.

The process of adapting a child, especially an older child (over 7 years old), to a new adoptive family will also be facilitated.

In addition, the draft introduces changes to the rules for transforming non-professional foster families into professional foster families and signing contracts with new professional foster families and those who run family orphanages. The amendments are intended to facilitate the signing of contracts with staroste other than the staroste responsible for the residence of the foster family or the candidate.

A rule will be introduced that, among other things, a poviat – in which there are foster families or family orphanages – may only refuse the placement of a child in a particular foster family or family orphanage if the number of children placed in a foster family from outside the poviat is more than 25%.

This solution is to limit the placement of children in institutional foster care despite vacancies in family foster care.

The amendments also provide for the introduction – using an ICT system – of a register containing a list of children placed in foster care and adults in foster care. This register contains, among other things, a list of persons with a negative and positive basic qualification for exercising the position of foster family or running a family orphanage, a list of candidates who are qualified to fulfill the functions of a foster family or running a family orphanage. to enter, a list of foster families, a list of family children’s homes.

In addition, the draft law introduces uniform criteria for access to a one-off benefit of PLN 4,000, which derives from the Act on the Support of Pregnant Women and Families “for Life” for biological families and families adopting a child.

The new regulations come into effect on the first day of the month, 3 months after the amendment was published in the Journal of Laws.
