The draft amendment to the regulation on fees for the use of living quarters at the disposal of the Medical University of Warsaw has been published on the website of the Government Legislative Center. The document was sent for inter-ministerial arrangements. What changes does it contain? What is in the motivation?
June 29, 2022 in the Journal of Laws, item In 1362, an ordinance of the Minister of National Defense was published, amending the ordinance on allowances for the use of living quarters at the disposal of the Military Property Service. With this amendment, instruments were introduced to moderate the increase in allowances for eligible persons, ie professional soldiers, military retirees and retirees, widows, widowers of professional soldiers and children of professional soldiers. The difference resulting from the calculated costs for the maintenance of homes, less the fees due, is covered by the earmarked subsidy.
The changes introduced have reduced the frequency of changes in the level of the fees for the use of a home, which are paid by users of AMW properties once a year, but subject to change – depending on the calculation of the fees. calculation – change rates – may be done more often.
It has therefore become necessary to clarify that the amount of the fees for the use of a flat will not be changed more often than once a year, ie on 1 July, for rightholders. As emphasized by the Ministry of Defense, the amendment will ensure the stability of the financial situation of professional soldiers – in terms of compensation for the use of residential buildings – in a specific time perspective.
Due to the need to take steps to apply the proposed Regulations in the current year, it is reasonable for the proposed Regulation to enter into force on the day following its publication, in accordance with Art. 4 of the law of 20 July 2000 on the publication of normative laws and certain other legal acts (Journal of Laws of 2019, item 1461).

Does this solve the problems of high costs?
Unfortunately not. The draft only addresses the issues related to the frequency of changes in the fees for using the flat available to the Medical University of Warsaw. The provisions in this draft are without prejudice to the problems related to the possibility of applying regulated tariffs for consumers of heat and gas in apartments supplied by boiler houses owned by external operators. The Military Property Agency has still not received a response from the Energy Bureau chairman regarding the possibility of applying regulated tariffs. The question of whether there will be a breakthrough in this matter remains topical. Will there be a legislative initiative at the level of the Minister of Climate and Environment, but also of the Deputy Prime Minister and the Minister of National Defence? We have not received a response from the Operational Center of the Ministry of National Defence. We asked about issues related to the social and living situation of soldiers, including the number of applications for benefits in garrisons, which this year included drastic increases in the Polish Army Deans’ Convention, the General Command and commanders of subordinate units. The heating season will start in a few months. In this situation, it is extremely important to quickly implement protective measures and legislative changes to solve the problem that families of soldiers living in the garrisons of Wędrzyn, Żagań, Świętoszów, Sulechów, Nowy Glinnik, Hel, Wrocław and Bydgoszcz face on a daily basis.
