The current law of diagnosticians is more than 20 years old

Laboratories have been waiting for the Act of Diagnostics for more than 20 years. Currently, the provisions on the principles and conditions for conducting laboratory diagnostics in a medical diagnostic laboratory, the rules for obtaining the right to practice the profession of laboratory diagnostics, the pragmatics of the profession and pre- and postgraduate training of laboratory diagnostics , as well as the principles of organization and functioning of the self-management of laboratory diagnostics are regulated in the law of 27 July 2001 on laboratory diagnostics.

The bill on laboratory medicine was adopted by the Council of Ministers on June 28 this year. We remind you that the draft was published on the website of the Central Government Legislation Center in 2020.

The draft defines the issues related to the principles and conditions for carrying out the activities of laboratory medicine, practicing the profession of laboratory diagnostician and the supervision and control of laboratories. It also concerns the organization and functioning of the self-government of laboratory diagnostics.

The title of the lab diagnosis

According to the project, the title of laboratory diagnostician will be available to people who have completed higher education in the field of medical analyst or laboratory medicine.

Persons authorized to independently perform laboratory medical work in laboratories are:

  • laboratory diagnostician;
  • a practice doctor and a 1st or 2nd degree specialization in the field of analysis or in the field of microbiology or in the field of laboratory diagnostics;
  • a doctor with 2nd degree specialization in the field of microbiology and serology;
  • a doctor with the title of specialist in the field of laboratory diagnostics or the title of specialist in the field of medical microbiology.

A new solution in the draft law is the introduction of a provision allowing a laboratory diagnosis with scientific or professional achievements in a particular field of laboratory medicine to recognize this achievement as equivalent to the implementation of specialization training. In accordance with the provisions of the draft law, the Minister responsible for Health may, at the request of a person with scientific or professional achievements, on the advice of a team of experts appointed by the Director of the Medical Center for Postgraduate Education, to recognize this achievement as equivalent to the implementation of a specialization training program. Those interested can submit applications for recognition of scientific and professional achievements to the Medical Center for Postgraduate Education.

Laboratory diagnosticians recognized by the Minister of Health can immediately take the specialization exam and, after a positive result of this examination, are entitled to the title of specialist in a specific area of ​​laboratory diagnostics.

The draft law also provides for the recognition of the profession of laboratory diagnostician as the exercise of the profession of laboratory diagnostician: exercising functions in self-governing bodies of laboratory diagnoses, employment in a medical entity in administrative positions, where activities are related to the preparation, organization or supervision of the provision of health services, employment in entities that are required to fund health services from public funds or offices, these operating companies, including activities related to the preparation, organization or supervision of the provision of health care services, employment in government agencies, including health protection supervision and participation in activities related to the granting of accreditation and the granting of certificates and notifications to laboratories.

The solution will increase the number of specialists and thereby increase their availability in the medical services market.

Up to 6 working days of paid training leave will be introduced, which can use the laboratory diagnosis for the implementation of continuous professional development.

Laboratory Manager Qualifications

The bill introduces qualification requirements for the head of the laboratory. She can be employed in the position of laboratory manager on a full-time basis, only the person mentioned in art. 4 of the Draft Act, namely a laboratory diagnostics or a doctor with a practice license and a 1st or 2nd degree specialization in the field of analysis or in the field of microbiology, or in the field of laboratory diagnostics, or a doctor with a 2nd degree specialization in in the field of microbiology and serology, or a physician with the title of specialist in laboratory diagnostics or the title of specialist in medical microbiology.

The head of the laboratory can be the above: a person with the title of specialist in one of the areas of specialization according to the profile of the laboratory, responsible for the organization and operation of the laboratory, having fulfilled the requirements set out in the draft law to demand. The position of laboratory manager can be filled full-time in one laboratory.
Therefore, the optimal operation of laboratories will translate directly into the safety and reliability of test results and consequently the quality of the services provided, and deliver measurable financial benefits.

A sole proprietorship

The draft law introduces provisions that make it possible to practice the profession of laboratory diagnostics in the form of a sole proprietorship as an individual laboratory diagnostics practice and group laboratory diagnostics practice.
Diagnostic doctors who work in the context of professional practice are registered in the register of entities that perform medical activities, as referred to in the Medical Activities Act.
The authority that maintains the register of entities carrying out medical activities in the field of laboratory diagnostics profession is the National Council.

The draft law also clarifies the provisions on the registry of penalized laboratory diagnostics maintained by the National Council. The list of data included in the entry in this register has been established.

The data referred to in art. 138 seconds. 2 of the draft law, at the request of a court, law enforcement or public authority – to the extent necessary for the performance of legal functions, be made available in the event of pending proceedings, including administrative, judicial and preparatory proceedings in accordance with generally applicable legal provisions, which impose the obligation to disclose personal data.

Qualifications of humans except laboratory diagnostics

The draft law contains, analogous to the regulation of the current law on laboratory diagnostics, provisions stipulating: qualifications that other people, except laboratory diagnostics, should haveauthorized to carry out strictly defined activities of laboratory medicine.

Persons authorized to carry out the work of laboratory medicine in the laboratory also include persons who have the professional title of medical analytical technician, have a bachelor’s degree in the field of medical analyst and persons who have completed a uniform master’s degree or first and second degree studies in biology , medical biology. , medical microbiology or microbiology or biotechnology or medical biotechnology and have obtained the professional title of Master or Master of Engineering.

Studies in the above-mentioned fields of study are generally carried out as studies of the first cycle and of the second cycle, while the fields of study that are or can be carried out as uniform master’s programs are specified in the regulation issued on the basis of art. 81 of the Act of 20 July 2018 – Higher Education and Science Act.
