Changes to insurance codes in ZUS documents. There is a draft of amendments to the regulation on patterns

  • A draft regulation of the Ministry of Family and Social Policy has been published in the RCL regarding changes in the format of documents submitted to ZUS
  • As we read in the document, the regulation will enter into force on the day of its publication, but with effect from July 1, 2022 (an exception is one regulation, which will enter into force on January 1, 2023)
  • The changes in the documents include applications for social insurance and health insurance, or personal monthly reports

Planned changes in the documents for ZUS

There is a draft regulation of the Ministry of Family and Social Policy with a broad title, which reads in full: the regulation amending the regulation concerning the definition of application forms for social insurance and health insurance, personal monthly reports and personal monthly correction reports, notifications of the premium payer, clearing statements and corrective clearing statements, reports of data on work in special circumstances or of a special nature, information reports, letters of intent to file information reports, information about assignments for specific specific work and other documents.

According to the draft regulation, amendments are to be made to Annex 25 to the Regulation of 20 December 2020:

  • in Part I. “Insurance Title Code” in Section 1. “Base Entity with Extension”:

– the words “05 43 – partner of a sole proprietorship with limited liability and partners of a general partnership, limited partnership or partnership and a shareholder of an ordinary public limited company responsible for the performance of work or services” are replaced by the words ” 05 43 – partner of a sole proprietorship with limited liability and partners of a general partnership, limited partnership or partnership, general partner in a limited partnership and a shareholder of an ordinary limited liability company providing work or Services”,

– the words “22 50 – the person appointed to perform the function pursuant to the instrument of appointment, who receives remuneration thereon”, are replaced by the words “22 50 – the person appointed to perform the function to exercise pursuant to the deed of appointment and the power of attorney referred to in Article 66, paragraph 1, point 35a of the Law of 27 August 2004 on publicly funded health services “;

  • in part XVI. “Code of the legal basis for termination or termination of the employment or employment relationship”:

– the words “427 – Article 63 of the Law of 26 June 1974 – the Labor Code in connection with Article 18 (2) of the Law of 11 September 2003 on the military service of professional soldiers” are replaced by the words “427 – Article 63 of the law of June 26, 1974 – the labor code in connection with article 189 sec 2 of the law of March 11, 2022 on the defense of the fatherland “,

– the words “428 – Article 63 of the Law of June 26, 1974 – the Labor Code in connection with Article 122 (1) of the Law of November 21, 1967 on the universal obligation to defend the Republic of Poland” are replaced by the words ” 428 – Article 63 of the Law of June 26, 1974 – the Labor Code in conjunction with Article 315 (1) of the Law of March 11, 2022 on the defense of the homeland “.

Summary of the proposed changes

As we read in the explanatory memorandum accompanying the draft decree, it was necessary in connection with the provisions of the Homeland Defense Act and the Income Tax Amendment Act and certain other laws to to be issued in the context of adapting the insurance title codes to the changes introduced by the above laws.

“The purpose of the changes introduced in the amended regulation is to enable premium payers to correctly complete insurance documents, and thus report correctly to social security and health insurance, and to settle premiums. regulation changes in annex 25 to the regulation” – we read.

At the same time, it was emphasized that the provisions of the Regulation would allow premium payers to fill in the insurance documents correctly, which would allow correct payment of premiums, thus justifying retroactive application of the provisions.

Therefore, the proposed date of entry into force of the provisions is July 1, 2022 – the exception is the provision introducing the insurance title code for a general partner in a limited partnership, which is to be applied from January 1, 2023.
