According to the draft, juvenile offenders of the most serious crimes, such as murder, rape, pedophilia, will be sent to penitentiary institutions. Children and young people from 10 to 24 years old can go to penitentiary institutions.
The law also authorizes a minor to use direct coercion in the form of physical violence. This applies to the costs of a youth training center, a shelter for minors and a penitentiary. If physical strength is insufficient, self-harm or an attempt at life may include the use of handcuffs, straitjacket, seat belt, and isolation chamber.
Another solution involves students – for less serious crimes, school principals can send children to schoolhouse cleaning tasks: raking leaves, mowing the lawn, cleaning, washing hallways, painting. The director may also issue an instruction, warning – oral or written, an apology to the injured party, or compensation for damages. Punishment takes place with parental consent. The penalty catalog is closed.

– It is not a code, but the legalization of some reprehensible practices that have been committed before (…). Educators in the social probation service have been fighting for this for years. And this project wants to legalize it all – says “Wyborcza” Prof. Marek Konopczyński, Vice-Chairman of the Pedagogical Sciences Committee of the Polish Academy of Sciences and Head of the Department of Special Education of the Faculty of Pedagogy and Psychology of the University of Białystok.
– What is included in this project has nothing to do with rehabilitation. It’s more like a prison system. It is strange that the new draft duplicates the solutions of the law of 40 years ago: the provisions on educational measures were rewritten from the legislation created during the time of the Polish People’s Republic, right after the introduction of martial law. Contemporary authors haven’t noticed that reality and educational resources have changed significantly since then – he estimates.
And he points out that when the law goes into effect, the 24-year-old will meet the 10-year-old at the penitentiary. – What does the latter gain from this? He will learn a more professional approach to crime and avoid responsibility from his older colleagues. It’s outrageous – Prof. Konopczyński.
– The previous law set the liability threshold for demoralization at 13 years. Psychological, neurobiological, social and exact sciences unequivocally state that a 10-year-old cannot assimilate the system of values, morals and principles of social life because his brain is not yet capable of it, and so is his psyche. 40 years ago, when the juvenile delinquency law was introduced, they knew about it, he says.
Next, Konopczyński referred to the changes regarding punishment in schools. – I feel sorry for schools, because integrating them into the legal system can completely change their face. I had it at my school. I stood in the corner, locked in the tool shed after school and the janitor looked at me. We go back to the sweet 60s. The school turns into a prison, a Prussian school from the 19th century, he adds.
