On Wednesday (May 25), he delivered a verdict on the appeal of Piotr M. who was accused of bullying a herd of cows in one of the towns in the municipality of Olsztynek. The court reduced the custodial sentence to six months and sentenced him to one year of imprisonment.
Piotr M., acting as the agent of the company W. and its 100% shareholder, was responsible for livestock breeding on a farm in one of the towns in the municipality of Olsztynek. According to the findings of the prosecutor, Piotr M. allegedly harassed a herd of cattle, which numbered 240 cows, from December 2017 to September 7, 2018, leading to breeding in a way that could harm the lives and health of the animals. directly threatened. Among other things, the accused had to limit the animals’ current access to water, fail to provide them with proper veterinary care and provide them with insufficient amounts of food, which are moldy, dry and infested with weeds. According to the researchers, the manure was inconsistently removed from the barn, leaving the cows in the manure. Cows had to drive with dogs and a car with a horn, which caused unnecessary suffering and stress.
The prosecutor also presented the accusation of abuse of the herd of cows from this farm to Jarosław Z. On the night of September 3-4, 2018, the man would order and actively participate in the transport of 110 cows to another farm. However, according to the prosecutor, these animals were unable to transport due to their extreme health condition due to malnutrition, emaciation and lack of proper health care about them.

A verdict will be announced on December 13, 2021 in which the court found both suspects guilty of committing the alleged act.
As a result, Piotr M. was sentenced to 2 years ‘prison sentence’, while Jarosław Z. to 6 months in prison with conditional suspension of this sentence for a probationary period of 2 years.
The court also ruled against Piotr M. for the confiscation of 11 dairy cows collected by the mayor of Olsztynek on September 6, 2018, as well as criminal measures in the form of a 10-year ban on breeding stock and a 5-year ban on all economic activities related to the use of animals.
The court also ordered extras of PLN 100,000 from both defendants. PLN from Piotr M. and 10 thousand. PLN from Jarosław Z. to the Emergency Hope Fund for Life Foundation.
The court further ruled that the verdict had been made public by both defendants by displaying it on the bulletin board of the town hall in Olsztynek for a period of 6 months.
This decision has been appealed by the accused Piotr M., his defenders and the auxiliary prosecutor – the Emergency Hope Fund for Life Foundation.
On 25 May 2022, the court in Olsztyn, VII Criminal Appeal Division, amended the judgment of the Court of First Instance and reduced the sentence for deprivation of liberty to 6 months, but also sentenced the perpetrator to a one-year suspension of liberty combined with the obligation to perform unpaid supervised work for social purposes amounting to 30 hours per month (mixed penalty). The rest of the verdict was upheld.
The court stated orally substantiated that the findings of the court of first instance in this case are completely correct, so that there is no doubt that the accused committed the offense charged.
On the other hand, the court ruled that the prison sentence imposed on the accused by the court was too severe. The appeals court noted that the accused was not some kind of monster who willfully wanted and intended to make the animals suffer. The management of a large herd of dairy cattle exceeded the capabilities of Piotr M. Defendant, seeing that things were getting out of hand, that the animals were not properly cared for and that they were suffering, could not find a good way out of this situation, and any decision he made only worsened the condition of the animals.
By imposing a mixed sentence on the accused (imprisonment and deprivation of liberty after serving), the court has primarily aimed at strengthening the direct impact of the sentence on the offender, and in the longer term on the educational impact of such a sentence. on the suspect, so that he would never behave towards animals like these again.
